Firefighter medical exams questioned

Another financial practice of the Warwick Fire Department has raised more questions than answers at this time, as documents outlining negotiations for the 2012-15 collective bargaining agreement seem to conflict with the fiscal reality of what has been funded within the fire department’s budget since then.

The line item in question – which is itemized under code 35-335 as “medical examinations” – is used to cover mandated medical tests that veteran firefighters are supposed to undergo each year. In prior contracts, most recently in the 2009-2012 deal, the contract has specifically stated that:

“Every employee forty-five [45] years or older may request a complete yearly physical by a doctor of his or her choice, which examination shall include an electrocardiogram, chest x-ray, complete blood count and urinalysis. Also, said employee may request a treadmill stress test...The cost of such examination and tests shall be paid by the City. The medical report to the City of said physical paid for by the City shall be limited to a report on whether the employee is fit and able to perform the duties of said employee’s position.”

However, in documents acquired and analyzed by the Beacon, the tentative agreement for the 2012-15 contract specifically removes a sentence of that provision, stating that the new deal would, “Eliminate provision for City to pay for annual medical exam and/or tests that are covered by any health insurance provider.” The change would, on the surface, appear to take the city off the hook paying for medical tests that otherwise are covered by firefighters’ Blue Cross insurance plan.

Along with the clear change mentioned in the tentative agreement, then-city Finance Director Ernest Zmyslinski produced a fiscal note delivered to then-Mayor Scott Avedisian and the City Council dated July 5, 2012 that specifically includes $58,000 in savings each of the three years of the contract due to not having to pay for the “Medical Exam Provision,” as outlined in the note.

Regardless of both of these facts, the medical evaluations line item was still given $80,000 in FY13 and was given $10,638 in FY14. It was then given $52,138 in FY15 and has received a base budget of $60,000 in fiscal years 2016-19 since.

More puzzling, however, is the varied fluctuations in how much money was actually spent out of these accounts throughout the years. For example, in FY11 – before eliminating the contractual provision that left the city on the hook for paying the medical exams – the line item was funded with $80,000. By the time the next budget rolled around, the department had used just $58 of that budget.

It has been a similar story lately as well. In FY18 – although the finalized figures are not out yet – as of May 2018 the fire department had only utilized $10 of their budgeted $60,000 for medical evaluations. However, this didn’t affect the city council’s decision to once again fund the same budget line item in the FY19 budget, again for $60,000.

In total, between FY10 and FY17, the fire department has under-spent this line item by a total of $188,015. Only twice in that span did they expend beyond the budget – in FY15 when they overspent by $7 and in FY16 when they needed an additional allotment of $2,569 to keep from overspending the original $60,000 budget.

It is not clear what has happened to funds left over from this line item because, after April 15 of each year, city departments can transfer funds from within their own budget without first seeking the approval of the city council. Fire department critics say that this provides an opportunity for the department to shuffle funds into their overtime budget.

A call to the administrative office for the Warwick Fire Department was not answered, nor was multiple calls to former fire union president Bill Lloyd, who was the union president at the time of the 2012-15 negotiations.

Current union president Michael Carreiro said that the contractual change was the result of an attempt at a compromise between the department and the city, but was ultimately found to be unfeasible.

“The intention was that some of the costs were high so we were trying to make some compromises with the city and the insurance carrier was going to pay for it,” he said. “Come to find out the insurance didn't pay for it because it was a requirement to have the physicals done. I think it was a misunderstanding between the insurance company and the city.”

When asked what tests might not be covered under their regular health insurance plan that would necessitate a budget line item in order to pay for them, Correiro did not provide a clear answer, as different firefighters have to take different tests, such as if they are on the hazmat unit. He said that the firefighters are supposed to go in for a normal round of testing every year but for reasons unbeknownst to him, that hasn’t been happening as it is supposed to be.

“I don't know the exact reason why we haven't had one this year,” he said. “That would be an administrative decision.”

The issue will likely be a topic of discussion at the Jan. 9 meeting of the City Council, as a docketed item is a request from the Warwick Fire Department to fund the medical evaluations line item with $125,000, which would be by far the largest allocation in the span of time researched by the Beacon for this article.

City Council President Steve Merolla said on Monday he knows which way he’ll be voting in regards to that request.

“We'll see what the rest of the council's position is, but in my opinion it's redundant. They have health insurance,” he said. “I've been saying this for years. To me, [the budgeted amount] was not used because it wasn't necessary.”

Warwick, like every other municipality, had some people trying to take advantage. If I was in that system, I might care more about my family than my City, too. No one wants to pay a bill if they don't have to. I don't read anything in the above article that is a major offense. However, if I was the Mayor, I would tighten up these loopholes, just like Mayor Solomon and union president Mike Carreirois are doing. Carreiro has clearly explained how he and previous President Bill Lloyd legally and ethically negotiated the previous collective bargaining agreement with the Avedisian administration. If that agreement was too flexible or too vague, blame Avedisian. He OK'd it. The end result of this new negotiation should benefit everyone, including the 80,000 taxpayers that are paying the tab.

Good job to everyone involved in this improvement, including Mayor Solomon and present union president, Mike Carreiro. I'm sure they invested many hours to make the system better for everyone.

As a taxpayer, I would like to know where the money that wasn't spent on the line item was allocated. If it wasn't needed for medical examinations, where was it spent? It shouldn't be difficult to work up the numbers and provide the information. It isn't an unreasonable request. Finger pointing can happen once the investigation has concluded. Until then, simple answers would be very welcome.

Mrs. Travis's address, as listed on her campaign finance reports, is 733 Oakland Beach Avenue.

In reviewing the information provided by the city, it appears that she did, in fact, pay the taxes on that property; I have reviewed 2011 through 2018, and with the exception of two future scheduled payments in January and April, 2019, all payments are listed on the website as being made.

I don't know Mr. Simoneau, and I haven't heard of his allegations before reading them here, but from a review of the information provided by the city on its website, it does not appear that Mrs. Travis failed to pay her property taxes.

Check the bill for 735 Oakland Beach Ave . The property used by her for parking and storage shed and husband's trailer and plowing equipment . They list it as owned by one of her alleged nonprofits Oakland Beach Real Estate Owners Association so they don't have to pay taxes. This organizations nonprofit status was revoked by Secretary of State for 20 months 20011 to 2012, so taxes owed and still not paid while interest accruing. Got status renewed after 20 months, so no taxes due since. This property owned by same alleged nonprofit years ago had a building that City had to tear down because neglected, so now used for their personal property tax free. City placed lien on property for tearing down cost of $3800. Later City released lien, although that wasn't paid either I believe. Lien release only says Cuty reached agreement with JONAH, another of her alleged nonprofits. All a scam and I think FRAUD on taxpayers of Warwick for years, and still continues.

This is the parcel that Mr Simoneau is referencing. It is 735 Oakland Beach Ave. Listed as the OB owners association. It is property adjacent to Donna Travis house. The property has been used by her and her husband for years storing personal property on it, cars, trucks, snow plow, shed, campaign signs, etc... He is correct commenting that the taxes are unpaid. There have been several media reports pertaining to this item as it relates to the Travis's. Unpaid taxes are not new to Donna Travis. She has had delinquent property and auto taxes in the past.

Everybody do this. Go to RI Secretary of State. Form a nonprofit. Sign your property over to that nonprofit, with your use for life. Live there, or use the property, tax free for life....... unless nonprofit status gets revoked for some reason. Brown University and other nonprofits have been doing this for years, especially with rich people on East Side. Newport, and apparently certain politicians in Warwick !

Thecaptain has provided his numbers and how he got to those numbers on numerous media sites. He has been on TV, radio and print discussing his research. Nothing has been hidden. He also has another citizen that has come to the same conclusion based on his independent research. Ken Block has certainly been instrumental in digging down on the WFD issue along with Cote. You are entitled to your opinion but your the one that hasn'tt provided facts to support your argument.

The side deals are an issue. They were not passed through the council and voted on before they went into effect. The fact that the medical exams were not performed or followed up is also an issue. The money was earmarked for one purpose. If it isn't being used for that purpose, it shouldn't just get thrown back into the general fund. If it isn't used for that purpose, it should go back to the city to be used for another need. Pretty nonchalant attitude about taxpayers money if you ask me.

I've read and seen enough...We have a new mayor and Council President...The question is, will they take this information and put it before a grand jury? This whole thing stinks to high heaven...I will not hold my breath for that to happen, after all, how can you be part of a solution when you were there during the problem? Look at Judge Stern gave a sentence to Providence councilman caught stealing over 100K, of immediate work release, and eligibility for parole in 6 months. Unconnected people stealing 100k don't get treated like that. But public does nothing.

The only solution "may just be a revolution" .... , lol...

and that won't happen once they take away your 2nd ammendment!

Some Warwick Fire Department Change of Shift facts

From 7/1/2016 through 5/31/2017, 1,539 changes of shift were awarded.

417 changes of shift were requested for the day before a scheduled 4 days off.

394 changes of shift were requested for the day after a scheduled 4 days off.

46% of changes of shift were adjacent to a change of shift on the next day for the same firefighter.

207 Warwick firefighters requested at least one change of shift.

16 Warwick firefighters took at least 5 more change of shift schedule changes than they provided. By contract, change of shift is supposed to ..

4 Warwick firefighters took at least 10 more change of shift schedule changes than they provided.

12 Warwick firefighters gave at least 5 more change of shift schedule changes than they provided.

3 Warwick firefighters gave at least 10 more change of shift schedule changes than they provided.

Private Waterman worked 14 change of shifts for Private Salisbury, who did not work a single change of shift in exchange.

Private Salisbury is a unique situation, as he strung together a huge number of shifts off in a row using changes of shift, along with sick days and vacation time. Salisbury took 30 Changes of shift while giving back 7. He took 29 vacation days, and also took 12 sick days. Salisbury only worked 110 shifts in our set of data, and we presume that he earned a full time salary for the year, as well as overtime working 3 shifts.

His time off is extraordinary. He was off for 28 days from 7/21/2016 – 8/17/2016, using only vacation time and the regularly scheduled off days. He was also off for 14 days from 12/2/2016 – 12/15/2016, using 6 changes of shift plus his regularly scheduled days off. He also was not at work for 12 days from 1/5/2017 – 1/16/2017, using 4 straight sick days. He was out for 22 days from 3/8/2017 – 3/29/2017 using both vacation time as well as changes of shift. He was out for 26 days from 4/8/2017 – 5/3/2017. The listed extended off time above amounts to Waterman’s other uses of change of shift served to extend his normal 4 off days by at least one extra day. He long absences (which are not illness related) amount to 102 days.

Changes of shift frequently are used on either side of 4 scheduled days off.

Nearly every claim made by the two-time election reject has been proven false when compared with publicly available and easily found information.

Where he could have admitted to his tax delinquency, instead he denied public information that proved his failure to pay property taxes, leading to the loss of his former residence to tax sale, and claimed he had “won” a court case against his lender.

Where he could have corrected his false claims about changes in Warwick’s population and school enrollment — based on numbers that he invented by misinterpreting legitimate data — instead he repeated them, over and over again, showing that he did not care how completely the facts proved him wrong.

Where he could have corrected his version of how the FY18 budget was passed, instead he kept repeating the claim that his failed 2016 campaign influenced the city council to cut spending and taxes over former Mayor Avedisian's "tax increasing amendments" — when, in fact, every single part of his claim was proven to be a lie.

Where he could have tried to earn his party’s endorsement, instead he first falsely claimed on his website that he had it, and then attacked his party as “political insiders” when he didn’t receive it, despite the fact that many of those same people contributed to his 2016 campaign.

As if all that weren’t enough, he used this website as a free advertising platform for his campaign activities, attacking others, making wild accusations against public officials, and using a fake title that he neither earned nor deserved.

He is the last person who should be accusing others of dishonesty, and his continued behavior proves that honest, taxpaying voters were 100% correct in rejecting his candidacy twice.

Jon the city council did not vote on the concessions by all 3 unions. That was a side deal between the mayor and unions and it was well publicized. So according to Cote all side deals are considered illegal. I’m just wondering if this will be recalculated to all 3 unions both retired and not.

It has to do with weekly pay, holidays, overtime, details, sick time, etc.

All are tied into everyone’s salary so I’m sure 5% reimbursement will help many.

Where were the present day accusers back then when the unions helped the city ?

Conclusion: whatever concessions were implemented by the administration and agreed to by the unions resulted in only 1 year (2009 to 2010) where expenses were reduced. Those saving were wiped out in the 2011 year as expenses increased by $4.4 million, meaning the temporary cuts were restored above and beyond the cuts.

Bottom line: Expenses related to the 3 municipal union salary and benefits have steadily increased at times by very significant amounts year over year and whatever concessions that were agreed to through either “side agreements” or contractual, DID NOT reduced overall employee expenses and the 5% pay cut argument you make is nothing more than a fallacy.

Thank you Bob Cushman for your expert analysis which completely debunks the Daydreamers claim. In particular, your numbers also support another claim that I have made publicly for quite some time.

As you are aware we have both been heckled for making statements that in the contract years of the no wage increase (2013-15), there was manipulation of overtime that took place particularly within the fire department. I received from the city, a list of each firefighter that was on the unused sick pay report. I was given their base salary and their year end wage for each of those 3 years. There were 114 men on the report and all but one man showed a significant increase in wage in each of the 3 years. Some as much as $40,000 increase in each year.

It was very clear and obvious that there was sicktime/overtime manipulation and you will note that this was the time period where the 3 schemes that have recently been made public, were put into effect.

So the Daydreamer can make all of the unsubstantiated claims that he wishes (without substantiation) but the numbers and the departments nefarious behavior tells a much different story.

I am wondering why the department has not released any of the numbers that have been produced by the unions own accounting firm Ward Fisher? Maybe it is because they like me so much that they don't feel it would be appropriate to prove me wrong? Maybe they just want to keep the findings all to themselves because they feel it would be inappropriate to defend themselves? Or maybe their own CPA firm will produce a report which indicates that we have had a bunch of lying stealing conniving selfish stealing dirt bags running this department and stealing from our children for many many years.

It is comical how Rob Cote is allowed to smear the hard working members of the City of warwick (fire dept and public works) but he wont pull his antics with the cops, why? because the public works guys and the firefighters dont have any recourse against him but the cops could pull him over after having a few too many and really jam him up. He is the voice of the vocal minority and we all laugh every time he films us and chucks us the bird and calls our bosses and the mayor wanting us suspended. He even has the former rat cop Simenaeu doing the same stuff, but with Simenaeu he scares me because he is a former cop and seems unstable when he is filming city workers and the FD in his pajamas. I live in OB and could care less if a fire truck or a city truck drives by the seawall and this is what all of my neighbors feel as well. Hopefully the Solomon administration will deal with Rob and his cronies and tell them to leave us alone. Maybe the new police chief will have the cahonies to let his officers deal with these goons unlike the former colonel.

I have no desire to compromise the integrity of our firefighters. I have nothing but respect for the work they do. My issue is really with the union leadership and the former administration. The side deal was really nothing more than a shell game. If it was approved as other contractual issues no one would be raising a red flag. My concern is making sure the practice of side deals is stopped. Any and all deals should follow the process and be reviewed by our leadership in an open and transparent manner. I think that is only fair considering the compensation isn't coming from a for-profit private sector. It is coming from the citizens of Warwick.

I think the time of doing the same thing just because it was always done that way is over. We need to start fresh. Review everything (all sectors, not just the WFD) with new eyes. We need to find better, more efficient ways of doing business. Let's be accountable to our stockholders - the taxpayers! We can make it happen. We just have to work together and throw out personal agendas.

How about this one. A senior citizen comes before the council because she hit a pot hole and blew out a tire. She waits 2 hrs to ask to be re-reimbursed for the damage. The council appeals committee headed by Donna Travis tells her that she is the first person to report that pot hole so they cannot pay her. Any idea how many times I saw Travis do that during the time period where she was 2 years tax delinquent on property and automobile taxes.

But worse, the council tries to justify this saying no one else has reported it yet we have in excess of 100 trucks, plus city cars on the road all day. None of which are equipped with GPS to tag the location to be fixed.

The city management is a mess, it needs a complete overhaul, but do not hold your breath.

I vacillate between positivity and negativity daily in regards to politics. I usually come out on the positive side. I do not think change will be easy but I think it can happen. We have had a changing of the guards, kind of. I know that there is a lot of baggage that comes along with Solomon and he certainly had a hand in helping the city get to where we are today but I am still hoping he will do the right thing. There can't be only a handful of people holding the leadership accountable. It will take all of us willing to speak up and keep our elected officials honest!

I agree, unfortunately there are things that already should have been done in the last 8 months which have not even been initiated. That concerns me greatly. I would expect if this administration is going to be forthright and honest, a very frank "State of the City" address should be coning soon. The news will not be good. I can assure you that we will see maximum tax increase for several years to come and most likely a supplemental tax as well.
